TERMS & CONDITIONS
FOR HIRE
1. APPLICATION
1.1 These conditions apply to all bookings.
1.2 Any brochure or promotional literature is for general guidance only - the
terms and basis of the booking are set out solely in these terms and conditions.
1.3 In these terms and conditions, "the Hirer" means the person or
entity that makes the booking, and "Turk Launches" means Turk Launches
Ltd.
1.4 All notices and correspondence should be sent to Turk Launches, Town End
Pier, 68 High Street, Kingston upon Thames, Surrey KT1 1HN
2. SPECIAL REQUIREMENTS
2.1 Any special requirements for access or carriage (in particular by wheelchair)
must be notified at the time of making the booking and agreed by Turk Launches
in writing. Where particular requirements are made known at the time of booking,
Turk Launches will endeavour to assist.
2.2 Turk Launches regrets that for operational reasons it cannot carry electrical
wheelchairs on any of its vessels. Certain vessels only are suitable for conventional
collapsible wheelchairs. Please enquire at the time of booking. Wherever operationally
feasible, Turk Launches will make every reasonable endeavour to accommodate
your requirements in this respect.
3. PAYMENT
3.1 A minimum deposit of £300 is payable upon the making of the booking,
and the balance is payable in full no later than 28 days before the scheduled
sailing date.
3.2 If a booking is made within 28 days of the scheduled sailing date, payment
is required in full on making the booking.
3.3 No booking is valid until the booking form has been received by Turk Launches,
the deposit (or, where due, the full amount) paid and booking confirmed in writing
by Turk Launches.
3.4 Turk Launches reserves the right to decline to accept any booking unless
these requirements are complied with.
3.5 Where payment is not made by the due date, Turk Launches reserves the right
to decline to operate the scheduled sailing.
4. CANCELLATION
4.1 If the booking is made by a consumer, notice is given in accordance with
Regulation 12 of the Consumer Protection (Distance Selling) Regulations 2000
(SI 2000 No. 2334) that the consumer has the right to give notice of cancellation
of this booking to Turk Launches. Such notice must be given no later than the
expiry of seven working days beginning with the day after the day on which
this contract is concluded. If this booking is cancelled where these Regulations
apply and in accordance with these Regulations, then any charges paid to Turk
Launches will be refunded.
4.2 Save where notice of cancellation is validly given under the provisions
of Clause 4.1 above, the whole amount of the hire, entertainment and any other
charges are payable in the event of the cancellation of the booking by the Hirer
within eight weeks of the date of the scheduled sailing.
4.3 Save where notice of cancellation is validly given under the provisions
of Clause 4.1 above, in the event of cancellation of the booking by the Hirer
more than eight weeks before the date of the scheduled sailing, Turk Launches
will retain the deposit as compensation for the cancellation, unless Turk Launches
receives another booking for the vessel for the scheduled sailing date and time
when the vessel was booked to sail, in which event the deposit will be refunded
less a reasonble administrative charge.
4.4 In the event of any emergency or event occurring preventing Turk Launches
from operating the scheduled sailing, then Turk Launches may by returning all
money paid and without further or other liability cancel the booking/contract.
5. VESSEL
Turk Launches reserves the right to substitute any vessel hired with another
vessel of similar capacity (including one provided by another operator) should
circumstances so necessitate.
6. DELAYS
6.1 Whilst Turk Launches gives any advice on estimated departure time, journey
time and return time in good faith, becasue of operational factors beyond it's
control it does not guarantee the start or completion of any sailing in any
specific time and will not accept any liability for any addditional expense,
cost, loss, delay or inconvenience caused by the actual times of the departure
and return.
6.2 Turk Launches and the Master of the vessel may at the discretion of the
Owner and/or Master vary the trip should circumstances so necessitate.
7. LIABILITY
7.1 Nothing in this agreement or clause removes or limits the liability of Turk
Launches for death or personal injury caused by something Turk Launches or
its employees or agents does or fails to do.
7.2 Turk Launches does not accept any liability for any indirect or consequential
loss.
7.3 Turk Launches will not be liable to the Hirer or any passenger for any additional
expense, cost, loss, delay or inconvenience caused if Turk Launches cannot operate
the sailing or has to curtail the sailing becasue of something beyond its control
(by way of example, adverse conditions on the river or unforeseen mechanical
breakdown).
7.4 In respect to of all other loss Turk Launches liability shall be limited
to the hire charges payable for this booking.
8. CONDUCT OF PASSENGERS
8.1 The Master of the vessel may decline any passengers whose conduct is in
breach of either safety regulations or is unreasonable or may cause injury
or nuisance to anyone else to board the vessel and may require that person
to be removed from the vessel.
8.2 Passengers must be alert to all safety notices displayed on the vessel and
to announcements made on the vessel and comply with all proper requests of the
Master and Crew.
9. PASSENGERS' PROPERTY
9.1 Turk Launches and the Master of the vessel will be the sole arbiter as to
the carriage of passengers' luggage and its stowage on the vessel and what
other equipment may be brought on board the vessel and used on the vessel.
9.2 All personal belongings and goods are brought and left on board at the passenger's
own risk. Turk Launches can accept no liability for loss, theft or damage from
any cause unless such loss, theft or damage arises from the negligence of Turk
Launches, its employees or agents.
10. CONSUMPTION OF FOOD AND BEVERAGES
- NO FOOD OR DRINKS MAY BE BROUGHT ON BOARD BY PASSENGERS
10.1 Only food or drinks provided either by Turk Launches or a supplier approved
by Turk Launches may be sold or made available for consumption on the vessel.
Please ask for details of Turk Launches approved caterers.
10.2 The Hirer must make arrangements with such approved caterers for its requirements.
The Hirer is recommended to make these arrangements now to ensure the chosen
caterer can meet the Hirer's requirements.
10.3 Any arrangements or contract will be between the Hirer and the Caterer.
Turk Launches accepts no responsibility for the provision of catering or for
the services provided by any such caterer.
10.4 This booking is not conditional upon any arrangements being made or contract
being entered into by the Hirer with any such caterer.
10.5 No alcohol will be served to those under the age of 18. Turk Launches operate
the Challenge 21 Scheme whereby proof of age is required for those passengers
who are considered by the bar staff to look under the age of 21 – acceptable
forms of identification are a card with a PASS logo, a driving licence or a
passport. Please ensure that you guests are aware of this policy, particularly
if you are organising an event with a large number of people in this age group – e.g.
18th or 21st birthdays, school and college leavers parties etc.
11. ENGLISH LAW
- This contract is governed by English Law.
